1. Acceptance of Terms
By creating an account, using PostMite, or accessing any of our services, you agree to be bound by these Terms of Service. If you do not agree, you may not use PostMite.

2. Description of Service
PostMite is an AI-powered social media assistant designed to generate captions, suggest media concepts, manage scheduling, and post on your behalf to supported platforms (e.g., Meta’s Facebook & Instagram).

You understand that PostMite uses artificial intelligence and third-party APIs to create and post content. You are fully responsible for reviewing, editing, and approving any content before posting, whether manual or automated.

3. User Responsibilities
You agree that you will not use PostMite to generate, store, or post:

• Illegal content of any kind
• Harassment, hate speech, bullying, or threats
• Explicit or pornographic material
• False, misleading, or deceptive information
• Spam or mass-produced misleading content
• Content that violates the policies of any platform you connect

You agree to comply with all policies of platforms you connect to PostMite, including Meta’s Community Standards, Instagram Terms of Use, and any relevant advertising or posting guidelines.

4. Platform Violations & Account Termination
Because PostMite connects directly to third-party platforms through API integrations, misuse of PostMite can result in API restrictions or bans that affect all users. Therefore:

If we receive reports from Meta or any integrated platform that your activity includes spam, policy violations, harmful content, or suspicious behavior, your PostMite account may be suspended or permanently terminated.

No refunds will be issued for terminations resulting from user violations.

PostMite reserves the right to take immediate action without notice to protect the integrity and availability of our API connections and our platform as a whole.

5. Data Ownership
You retain full ownership of all content you create or upload through PostMite. PostMite does not claim any rights to your posts, captions, media, or account data.

By using PostMite, you grant us permission to transmit your content through our integrated APIs for the purpose of posting or scheduling your content.

6. Payment, Billing & Refunds
Paid plans operate on a subscription basis. Fees are charged in advance.

All payments are final. No refunds are provided unless legally required.

If your account is terminated for violating these Terms or third-party platform rules, no refunds will be issued under any circumstances.

7. AI-Generated Content Disclaimer
PostMite provides AI-generated content for your convenience. However:

• You are responsible for reviewing content before posting
• You are responsible for legal compliance of all posted content
• PostMite makes no guarantee regarding accuracy, legality, or performance of any AI-generated content

8. Limitation of Liability
PostMite is provided “as is” with no warranty. To the fullest extent permitted by law, PostMite is not responsible for:

• Loss of social media accounts
• Suspensions, bans, or shadowbans
• API outages or failures from third-party platforms
• Lost revenue, lost opportunities, or reputational harm
• Any action taken by integrated platforms in response to user activity

9. Changes to These Terms
PostMite may update these Terms at any time. Continued use of the service constitutes acceptance of the most current version.
